Court recuses from hearing Dinakaran plea

NEW DELHI: A Supreme Court bench on Thursday recused from hearing a petition by Sikkim High Court Chief Justice P D Dinakaran, who has challenged the composition of the Rajya Sabha chairman appointed inquiry committee to probe charges of corruption and misconduct against him.

The bench comprising Justices D K Jain and H L Dattu said without citing any reason, “The matter will be placed before another bench for hearing on Friday.” The petition had been listed as a mentioning matter meant for seeking urgent hearing.

Justice Dinakaran’s counsel and senior advocate Amarendra Saran said, “We wanted a member to recuse from the inquiry committee, not the Bench.”

Justice Dinakaran has questioned the inclusion of senior advocate PP Rao in the committee headed by Supreme Court judge Aftab Alam. He has alleged that Rao was biased as the senior advocate had signed a memorandum opposing Justice Dinakaran’s purported elevation to Supreme Court as a judge. His petition alleged the “likelihood of bias”.
